FrancSwiss ‘victim’ sues NBI men

A man who said he was a victim of the FrancSwiss Internet pyramid racket on Friday filed charges of extortion against five agents of the National Bureau of Investigation.

Jomarc de la Paz filed the case with the Office of the Ombudsman against Executive Officer Rommel Vallejo, Supervising Agent Manny Fayre, Agent 2 Reynold Tabbu, and Special Investigators Joey Guillen and Michelle Fernandez, all assigned to the NBI’s National Capital Region branch.

De la Paz alleged that the agents picked him up at his house on July 2 and detained for four days without charging him of any crime.

The agents took some P2,500 cash, a laptop computer worth P80,000; two N70 Nokia cellular phones, two N95 Nokia mobile phones and pertinent documents from him and brother, he said.

The agents allegedly warned de la Paz and his brother not to tell anyone about the incident. He said the agents threatened to file several cases against them if they do not deliver. 

De la Paz said he was also made to sign a waiver of detention without the presence of his lawyer.

He said that after being brought to the NBI headquarters in Manila, he and his brother were brought to the Pearl Hotel across the street from the headquarters. There the agents told them they would be set free if they hand over P2 million. De la Paz said he haggled with the agents and they agreed on P500,000.

In a separate affidavit, Teresita Bravo, de la Paz’s sister, said she and the de la Paz’s wife, Annaliza, even tried to lower the amount to P200,000 but the agents refused.

De la Paz said he was freed after paying the amount but his Mercedes-Benz and other valuables, like several checks and his ATM card, were never returned to him.

He admitted that he and three other friends had invested $1,000 in FrancSwiss and later on convinced his mother-in-law to invest as well.

Regional Director Ruel Lasala, chief of the NBI in the National Capital Region, issued a statement saying that while he had not received a copy of de la Paz’s complaint he would cooperate with the Ombudsman.

“I believe that my men are innocent,” said Lasala. “We were already expecting harassment suits such as this in the course of our investigation because FrancSwiss is a well-organized and well funded group.”

The NBI has received 200 or more complaints against FrancSwiss involving at least P300 million.

Lasala said his department was compiling at least 300 complaints before filing the initial batch before the Department of Justice.
